By downloading, installing, or using the Quez mobile application ("the App"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the App.

1. Acceptance of Terms

By downloading, installing, or using the Quez mobile application ("the App"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the App.

2. User Accounts

2.1 Account Creation

  • You must be at least 13 years old to use the App.
  • You must provide accurate and complete registration information.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.

2.2 Account Types

Customers: May browse businesses, place orders, and make bookings. Businesses: May list services, process orders, and receive payments. Administrators: Have access to platform management tools.

3. User Responsibilities

3.1 Acceptable Use

You agree not to:

  • Use the App for any illegal or unauthorized purpose.
  • Violate any laws in your jurisdiction.
  • Submit false or misleading information.
  • Interfere with or disrupt the App's functionality.
  • Attempt to gain unauthorized access to other users' accounts.
  • Upload viruses or malicious code.
  • Spam, harass, or intimidate other users.

3.2 Content Standards

Reviews and ratings must be truthful and constructive. Business information must be accurate and up-to-date. Profile pictures and business images must be appropriate and relevant. No offensive, defamatory, or inappropriate content.

4. Payments and Financial Terms

4.1 Payment Processing

All payments are processed through Pay Stack payment gateway. You agree to pay all charges incurred through your account. Refunds are subject to business policies and platform guidelines. The App acts as a facilitator between customers and businesses.

4.2 Business Payouts

Businesses are responsible for providing accurate banking information. Payouts are processed according to the platform's withdrawal schedule. The platform may deduct applicable fees and commissions. Businesses are responsible for their own tax obligations.

5. Intellectual Property

5.1 App Ownership

The App, including all content, features, and functionality, is owned by Quez. You may not copy, modify, or create derivative works without permission. The Quez name, logo, and all related names are trademarks.

5.2 User Content

You retain ownership of content you submit to the App. By submitting content, you grant Quez a license to display and distribute it. You are responsible for ensuring you have rights to any content you upload.

6. Privacy and Data

Our collection and use of personal information is governed by our Privacy Policy. By using the App, you consent to such processing.

7. Service Modifications and Availability

7.1 Service Changes

Quez reserves the right to modify or discontinue the App at any time. We may add, change, or remove features without prior notice. We are not liable for any modification, suspension, or discontinuance of the App.

7.2 Availability

We do not guarantee uninterrupted or error-free service. The App may be temporarily unavailable for maintenance. We are not responsible for service interruptions beyond our control.

8. Termination

By You: You may stop using the App at any time by deleting it from your device.

By Us: We may suspend or terminate your account if you: Violate these Terms and Conditions; Engage in fraudulent or illegal activities; Create risk or possible legal exposure for Quez; Have not used the App for an extended period.

9. Disclaimers and Limitation of Liability

9.1 No Warranty

The App is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted or error-free.

9.2 Limitation of Liability

To the fullest extent permitted by law, Quez shall not be liable for: Any indirect, incidental, or consequential damages; Loss of profits, data, or business opportunities; Issues arising from third-party services (Pay Stack, etc.); User interactions and transactions between customers and businesses.

10. Business Relationships

Quez is a platform that connects customers with businesses. We are not a party to transactions between users and businesses.

11. User Disputes

Users are encouraged to resolve disputes directly with businesses. Quez may facilitate communication and intervene when matters escalate. We may suspend accounts involved in ongoing disputes.

12. Changes to Terms

We may modify these Terms and Conditions at any time. We will notify users of significant changes. Continued use of the App after changes constitutes acceptance.

13. Governing Law

These Terms shall be governed by the laws of South Africa. Any disputes shall be resolved in the courts of South Africa.
